Skoach Terms of Service

These Terms of Service (TOS) govern our clients’ use of our service. As used in these TOS, "Skoach service", "service(s)" or "Skoach solution" mean the service provided by Skoach, including all features and functionalities, our website www.skoach.com, our API, our App on Slack or Microsoft Teams (the “App”) and all our user interfaces, our interaction with our chatbot Skoach, as well as all content and software associated with our service.

About Skoach

Skoach is a virtual self-development assistant that promotes new behaviors for increased engagement and team effectiveness.

Skoach interacts 1-on-1 with everyone under a license.  We try to understand the specific context of each activated user and try to develop their skills and promote new behaviors that improve the team effectiveness.  We do this by creating an open and direct communication window with each of the activated members, challenging them to grow by stepping out of their comfort zone, promoting new habits, and improving team effectiveness and individual engagement.
Activated users can follow the dialogue with Skoach to continuously engage with us.

We integrate with our clients’ Slack or Microsoft Teams, via their API. For more information on our product please check our website

Our Clients can be companies or individuals, so different terms may apply, as we explain below.

License and number of users

Skoach grants companies or individuals a limited, non-exclusive, non-transferable license, without rights to sublicense, to use our software exclusively for talent development, team alignment or self-development purposes Access to the Skoach App is only available to activated users. By using Skoach services, you or a decision-maker in your Company may choose to involve some or all the employees and contractors or people in the workspace.The number of activated users can be changed on a monthly basis.

Price and payments

BILLING CYCLE

The license fee is paid quarterly in the case of corporate Clients and monthly in the case of Individuals, in the same day as the subscription was first created.

  • €6 / month / person for personal usage
  • €8 / month / person for usage in groups
  • Currently, all plans have a 14-day free trial

VAT may apply.

PAYMENT METHODS

Skoach service fees may be paid by Visa, Mastercard, Maestro, American Express, Apple Pay, Google Pay, or bank transfer.

UPDATING YOUR PAYMENT METHODS

You can update your payment method in a subscription by sending us an email to support@skoach.com to get access to our payment portal.

CHANGES TO THE PRICE AND SUBSCRIPTION PLANS

We may change our subscription plans and prices, but we will always let you know at least 30 days in advance. If you do not accept the price changes, you are entitled to cancel the services immediately.

Duration and cancelation

From the moment of subscription, services shall be active until you decide to cancel our Service. 

You may cancel your subscription at any time, terminating your access to the Skoach service at the end of the current billing cycle. To cancel Skoach services, please email cancel@skoach.com and tell us you would like to cancel your subscription, please.

We will consider the email sending date as the cancellation trigger and will get back to you ASAP.

For any support question, please email support@skoach.com. We will get back to you ASAP, and at most in 2 workdays.

Rights over content

CLIENT AND USER CONTENT

Skoach will challenge people to talk to one another, recognize each other, go through introspection, but never be abusive, offensive, or invasive of other individuals’ rights or privacy.

Clients and activated users are responsible for the content uploaded by them when using our services. 

However, please note, we reserve the right to block a user if inappropriate content is received by Skoach, namely illegal content as defined by the European Union: (i) child sexual abuse material; (ii) racist and xenophobic hate speech; (iii) terrorist content; and (iv) content infringing Intellectual Property Rights (IPR).

Terms of Service Updates

Occasionally we may make changes to this Terms of Service, but we will always let you know about the changes at least 30 days before they enter into force. If you do not agree with the news terms, you are entitled to cancel the services immediately.

Personal Data

Personal data of all users visible by Skoach is processed under the applicable legislation and you can check our Privacy Policy.

Skoach is not liable for any personal data activated users may upload or display into Skoach App.

Corporate clients must ensure they have obtained their employees’ or subcontractors’ consent before indicating them as an activated user in the Skoach App. 

Representation disclaimer of warranties

Except as expressly provided for herein, the services and all related components and information are provided on an “as is” and “as available” basis without any warranties of any kind, and we expressly disclaim any and all warranties, whether expressed or implied, including the implied warranties of merchantability, title, fitness for a particular purpose, and non-infringement. Customer acknowledges that we do not warrant that the services will be uninterrupted, timely, secure, or error-free.

Legal Information

Skoach is a solution that is provided by CULTIFY, LDA, a limited liability company based at Rua Duarte Barbosa, nº 364, 3 D, Porto, Portugal, corporate taxpayer number PT515469963.

These TOS shall be governed by and construed in accordance with the laws of Portugal.

In case any dispute, claim, or controversy between you and Skoach arises in connection with or relating in any way to these TOS or to your relationship with Skoach as Client, Lisbon District Courts shall be competent to settle the matter.
